1. Definitions
"Service" means the myspacecube.com website and the associated member account. "Software" means the MySpaceCube application installed on the user's device. "User" means any person creating an account. "Module" means an optional feature of the Software (budget, recipes, groceries, movies, calendar, family tree, etc.), included according to the subscribed plan.
2. Purpose
MySpaceCube is local-first personal software, installed on the user's device, which centralises everyday tools without sending the data you create to a remote server. The Service lets you create an account, manage a subscription, and obtain a licence to use the Software.
3. Acceptance of terms
Creating an account on the Service implies full and unconditional acceptance of these Terms. If you do not accept these Terms, you must not create an account or use the Service.
4. User account
You agree to provide accurate information when creating your account and to keep it up to date. You are solely responsible for the confidentiality of your credentials and for any activity carried out from your account. Any fraudulent or non-compliant use may result in suspension or immediate termination of the account.
5. Subscriptions, pricing and billing
Subscriptions are monthly or annual depending on the plan chosen, billed at the start of each period via Stripe. Prices are shown inclusive of tax on the Pricing page. Any period started is due in full. In the event of a failed payment, access to paid Modules may be suspended until the situation is resolved. Prices may change; any increase will be notified to you before it applies to your next billing cycle.
6. Renewal and cancellation
Unless stated otherwise at the time of subscription, subscriptions renew automatically at the end of each period unless cancelled beforehand. You may cancel your subscription at any time from your member area; cancellation takes effect at the end of the current period and no prorated refund is issued, unless otherwise required by law.
7. Right of withdrawal
In accordance with applicable European consumer law, you have 14 days from subscribing to exercise your right of withdrawal, without needing to give a reason. This right cannot be exercised if you have expressly requested that the service begin before the end of this period and acknowledged that you lose your right of withdrawal once the service has been fully performed.
8. Intellectual property
The Software, the Service, their interfaces, trademarks and content are the exclusive property of MySpaceCube and are protected by intellectual property law. Your subscription grants you a personal, non-exclusive, non-transferable right to use the Software for the duration of your subscription. Any unauthorised reproduction, distribution, decompilation, or modification is prohibited.
9. Community space and published content
The Service offers a community space where users may publish content (recipe and activity sheets, note binders and other items created in the Software) to share it with other members. Publishing is optional: no content is sent to the community space without an explicit action on your part. You may only publish content that you authored, or for which you hold all the necessary rights. Publishing content reproduced from a book, a magazine, a website, a third-party application or any other protected work is prohibited — a recipe copied from a cookbook, a text, a photograph or an illustration you did not create are examples of this. The mere fact that content is freely accessible online does not make it free of rights. Publishing content that contains third parties' personal data, or content that is unlawful, defamatory, hateful, violent, misleading or infringing on the rights of others, is likewise prohibited. By publishing content, you grant MySpaceCube a non-exclusive, royalty-free, worldwide licence to store, display and make it available to other members, for as long as it remains on the community space and for the sole purpose of operating that service. You retain ownership of your content and may request its removal at any time. Every submission is subject to prior moderation and may be refused, edited or removed without notice or compensation, in particular where a third party's rights are infringed. You remain solely responsible for the content you publish and shall indemnify MySpaceCube against any third-party claim arising from it. Any reported infringement may be sent to legal@myspacecube.com and will be reviewed as promptly as possible; repeated breaches may lead to suspension of access to the community space, or of the account.
10. Personal data
The processing of your personal data in connection with the Service is described in our Privacy Policy, which forms an integral part of these Terms.
11. Liability and warranties
As the Software is installed locally, you are solely responsible for backing up your data on your device. MySpaceCube shall not be liable for data loss occurring on your machine, for any interruption of the Service due to force majeure, or for any indirect damages resulting from use of the Software. Should MySpaceCube's liability be established, it is limited to the amounts paid for the subscription over the preceding twelve months.
12. Changes to these terms
MySpaceCube may amend these Terms, notably to comply with legal or technical changes. Any material change will be notified to you before it takes effect; continued use of the Service after notification constitutes acceptance of the new Terms.
13. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, you may use a free consumer mediation scheme before taking legal action. Failing an amicable resolution, any dispute shall fall under the exclusive jurisdiction of the French courts.
